An applicant needs to file a declaration with the USPTO to demonstrate that the applicant’s trademark has been continuously and extensively used in the open market. If an applicant is unable to file a Statement of Use within six months following the issuance of a Notice of Allowance, they may request a six-month extension of time to file this by submitting a request for an extension along with paying the required fees to the USPTO. The request for submission for an extension must be filed before the expiry of six-month time.
In the U.S., trademarks must be renewed periodically to maintain their protection and validity. The trademark registration period is 10 years, and after that, it can be renewed for another 10 years of duration. To renew a trademark registration, the owner must file a Renewal application with the USPTO within the designated period.
